Every1online WiFi Terms of Use and Privacy Policy

When you sign up for our in-home or public space WiFi service (“Service”), you agree to comply with these WiFi Terms of Use, and we agree to comply with this Privacy Policy.  Both the WiFi Terms of Use and the Privacy Policy may change somewhat from time to time, and when they do we will attempt to notify you via the email address you provide us when you sign up, but the changes will be effective whether or not we succeed in notifying you.  You can always tell when the current WiFi Terms of Use and Privacy Policy went into effect by looking at the date at the top.)

“You” means the person who signs up for our Service, and “we” (etc.) means Meta Mesh Wireless Communications, a 501(c)(3) organization.

WiFi Service Terms of Use

  1. Enjoy!  We hope you make good use of our Services and we wish you many hours of learning, fun, and joy! 

  2. Maintain control of your account.  If you use our in-home WiFi service, you may allow members of your household to use your account to access the internet, but you must supervise all such use to make sure that it does not violate these WiFi Service Terms of Use.  In particular, it is your responsibility to monitor the online activities of any minors who access the internet via your account, to ensure that their use is age-appropriate. Parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that is harmful to minors. If you use our public space WiFi service, you may not share your account information with anyone else. If someone else wants to use our public space WiFi service, have them contact us! 

  3. Understand that your account is for personal, non-commercial use only.  Don’t use your account to resell internet access, host content, or to engage in any other commercial activity.

  4. Use Responsibly.  Don’t use our Services to do illegal things.  Don’t infringe intellectual property rights (copyrights, trademarks, etc.). Don’t harass or threaten anyone, don’t engage in hacking, don’t upload malware, and don’t engage in hate speech.  If we receive credible complaints that you are using our Service to do such things, or to do anything else we deem objectionable, or if we notice that you are using your account for commercial purposes, we may – at our sole discretion – warn you, suspend your account for a period of time, or permanently terminate your account (without any pro-rata refund if you have a paid account).

WiFi Service Privacy Policy:   

  1. When you log in.  When you use our Services, we will know who you are because you will log in with the user credentials we have on file for you.  Our servers keep copies of login data (which may include username, IP address, dates and times online, identifying information regarding the device you use to access the internet).  Please be aware that all such information is potentially subject to disclosure to third parties, including but not limited to law enforcement, as a result of legal process.  

  2. Your personal information.  When you sign up for our Service, you give us personal information about you when you fill in the sign-up form.  We keep such information indefinitely (even after you no longer use the Service), but we do not disclose it, share it, sell it, or otherwise use it except for purposes of (a) administering your account in-house, (b) preventing fraud, and (c) complying with the law and with legal disclosure requirements.

  3. Security of your information.   We will exercise our best efforts to keep your personal information secure.  In the unlikely event of a data breach we will comply with Pennsylvania’s Breach of Personal Information Notification Act, 73 Pa. Stat. §§ 2301 et seq.

WiFi Service Agreement

This agreement is a contract between you and Meta Mesh Wireless Communications, a 501(c)(3) organization (“Meta Mesh” or “we”), for the purpose of allowing us to provide in-home or public WiFi service (“Service”) to you.  You must be 18 or older to enter into this agreement.

  1. Terms of Use, Privacy Policy.  You agree to comply with our Terms of Use, and we agree to comply with our Privacy Policy, for as long as this Wi-Fi Service Agreement is in effect.

  2. Payment.  If you have a paid account, you’ll be billed in advance for each upcoming month.  If you won’t be able to make your payment by the deadline, please let us know and perhaps we can work something out.  Otherwise, if we don’t receive payment by the deadline we can suspend or terminate your Service.

  3. Term.   Unless your sign-up form specifies otherwise, all Service is provided on a month-to-month basis, automatically renewed.  You can cancel at any time; cancellation does not affect any partly-completed month but only the next upcoming month. We can cancel at any time as well.

  4. Warranties and disclaimers/exclusions

    1. What we warrant:

      • Security of your Personal Information.  We will exercise our best efforts to keep your personal information secure, as stated in our Privacy Policy.

      • Service.  We will do our best to keep the Service up and running at all times.

    2. What we do NOT warrant (that is, what we disclaim/exclude):

      • Uptime or reliability.  Although we’ll exercise reasonable efforts to keep our Service online at all times, we can’t guarantee that the Service will be available at any particular time, or that there will be no significant outages – in particular since outages can be caused by situations beyond our control. We do not guarantee the reliability of our Service when it is running. 

      • Risks as a result of being online.  THIS IS IMPORTANT.  Our Service is provided on an AS IS – WITH ALL FAULTS basis. Your use of our Service is entirely at your own risk. We just provide internet connectivity; we have no control over how you use that connectivity. Accordingly, we aren’t responsible for anything that might happen as a consequence of your using our Service to connect to the internet. 

      • All other warranties. WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS AND IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF FITNESS AND MERCHANTABILITY.

  5. Remedies for breach of warranty; limitation of remedies.  If there is a data breach regarding your personal information, your remedy will be to notify the Pennsylvania Attorney General pursuant to Pennsylvania’s data breach law, 73 Pa. Stat. §§ 2301. Otherwise, your sole remedy for the breach of any of the above warranties is to discontinue your use of our Service and to receive a refund of what (if anything) you paid us for the goods or services regarding which a warranty was breached.  WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF, OR INABILITY TO USE, OUR SERVICE, EVEN IF WE HAVE BEEN ADVISED OF OR REASONABLY SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. 

  6. Notices.  You can notify us by emailing us at support@metamesh.org.  We can notify you by emailing you at the email address you provide us when you set up your account. If you need to change that address please let us know, if necessary by phoning us at (412) 223-4253.

  7. Miscellaneous.  Neither party may assign this agreement to anyone else; any purported assignment to the contrary will be void.  Our failure to strictly enforce any provision of this agreement does not constitute a waiver.  This agreement constitutes the entire agreement between you and us regarding the Services; any changes must be made in writing and (on our side) must be agreed to by an authorized representative.

WiFi Equipment Installation Agreement

This agreement covers the equipment we provide to enable you to enjoy our WiFi service.  “You” means the person who signs up for our Service, and “we” (etc.) means Meta Mesh Wireless Communications, a 501(c)(3) organization.

  1. Equipment and configuration. To enable you to access the internet, we will provide the equipment listed on Attachment A, “Equipment provided.”  We will configure it to enable WiFi access using your account with us, and we will provide you with instructions on how to use it to access the internet.  You’ll be responsible for reviewing and complying with any manuals for the equipment and any licensing agreements for any software that is used in conjunction with the equipment. You’ll also be responsible for configuring your own devices to access the internet via the equipment we provide.  As you know, we are providing the equipment to you at no charge; it is on loan to you and remains our property. Please take care of it. When this agreement expires or terminates, you’ll be responsible for turning our equipment back over to us; we’ll schedule a date and time for our representative to stop by and pick it up.

  2. Installation.   You will be responsible for ensuring the following:

    1. We will have whatever general permission is necessary from your landlord, property manager, etc. to install the equipment at your residence.  (Installation requires some exterior-mounted items as well as a wire connecting exterior and interior equipment, as listed on Attachment A.)

    2. You will allow our installer to enter your premises at the appointed time and to install the equipment.

    3. A responsible adult will be present at your premises at the appointed time, and will remain there at all times during the installation.

    4. Your premises will be safe for our installer to enter.  

    5. All persons at your premises will wear face masks when in the presence of our installer (at his or her request). 

  3. Our guarantee (and what we don’t guarantee).  We’ll make sure that the equipment we install works and that you can use it to access the internet.  We will use our own computer or phone to check to make sure the equipment does work and does connect to the internet. Although we think you’ll be really happy with your internet connection, we can’t guarantee that our equipment or service will function flawlessly, or that any particular upload or download speed will be available at any particular time. If you believe there’s something wrong with our equipment or service that is interfering with your internet access, please call us during normal business hours and we will try to help you solve the problem by phone. If that doesn’t help we will schedule a service call if we think that will help. If the problem is due to equipment that is damaged (in our sole determination) or missing, we might replace it but do not guarantee that we’ll do so.  

  4. Disclaimers:  THE GUARANTEES IN PARAGRAPH 3 ABOVE ARE THE ONLY WARRANTIES WE MAKE REGARDING THE EQUIPMENT.  WE EXPRESSLY DISCLAIM ANY OTHER REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. IN NO CASE WILL WE BE LIABLE TO YOU FOR LOST DATA OR ANY OTHER INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, EVEN IF WE HAVE BEEN ADVISED REGARDING, OR SHOULD HAVE KNOWN, THE POSSIBILITY OF SUCH DAMAGESWe do not independently warrant any equipment or software, but any manufacturer’s warranties and any limitations thereof that may apply to the equipment and/or software we provide may apply to you.

  5. Term.  This agreement is valid for as long as you have possession of our equipment. You may terminate this agreement at any time by returning our equipment to us. We’ll be happy to pick it up at your residence; just let us know and we’ll schedule a time.

  6. Entire agreement.  This agreement constitutes the entire agreement between you and us regarding the equipment listed in Attachment A.  Any changes to this agreement have to be in writing, and must be signed by both you and our authorized representative.
